2. Purpose
These Terms govern the online sale of the Pro Licence for the Home Theater Maestro (HTM) software, which unlocks the Pro features. Use of the software is otherwise governed by the End-User Licence Agreement.
Essential characteristics of the product sold:
- Digital content: a licence key unlocking the Pro features of software you install on your own devices. No physical medium, no subscription, no account to create.
- Two devices at a time: the Pro Licence purchased through this site activates on two devices at once. Reactivating or reinstalling a device already known does not use up a slot, and you may release a device at any time from within the app in order to activate another one.
- Internet connection: required for the first activation only. The software then works offline.
- Updates: those of the 1.x branch are included (see the EULA).
3. Price
- Pro Licence: €79 (one-time payment, perpetual licence, no subscription).
- VAT not applicable, article 293 B of the French General Tax Code (small-business exemption). The price is net of VAT.
- The applicable price is the one displayed on the site at the time of the order.
4. Ordering
Orders are placed online. The process includes at least: selecting the Pro Licence, a summary, express acceptance of these Terms, then payment. The sale is concluded upon payment confirmation; a summary is sent by email.
5. Payment
Payment is processed by Stripe, a secure payment provider. WM STUDIOS has no access to your full card details. The order is only validated once payment is authorised.
6. Delivery of the licence
The Pro Licence is digital content delivered electronically: a licence code is sent to the email address provided, immediately or as soon as possible after payment confirmation. You activate this code in Settings → About → Pro Licence. If you do not receive it, contact support.
7. Right of withdrawal and waiver
Under article L221-18 of the French Consumer Code, consumers have 14 days to withdraw.
However, as this is digital content supplied on an intangible medium whose performance begins immediately after purchase, article L221-28, 13° provides for the loss of the right of withdrawal where the consumer has (1) given prior express consent for performance (delivery of the code) to begin before the 14-day period ends, and (2) acknowledged that they thereby lose that right. A dedicated checkbox collects this double consent at the time of ordering. Once the code has been delivered with that consent, the sale is final. See the Refund policy for exceptional cases.
8. Statutory guarantees
Consumer purchasers benefit from the mandatory statutory guarantees, which cannot be excluded: the statutory guarantee of conformity for digital content and services (French Consumer Code, art. L217-3 et seq.) and the guarantee against hidden defects (French Civil Code, art. 1641 et seq.). If the Pro Licence delivered does not work as described, the purchaser may obtain its being brought into conformity or, failing that, a refund, under the conditions provided by law.
9. After-sales service
Support is provided via the “Contact support” button in the app. It covers in particular problems with the delivery or activation of the Pro Licence.
10. Liability
The seller’s liability applies under the conditions and limits set out in the EULA and by law. No provision deprives consumers of the rights they hold under mandatory provisions.
11. Personal data
For the sale, only the necessary data is used (email, payment data processed by Stripe), for the purposes of fulfilling the order and invoicing. The HTM app itself collects no data (see the Privacy policy).
12. Complaints and mediation
All complaints are handled directly by WM STUDIOS, which seeks an amicable solution with the customer (via support). No consumer mediator has been appointed at this stage, given the very small scale of the business.
13. Governing law
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any action; failing that, the jurisdiction rules protecting consumers apply.
14. Language
These Terms are written in French. Any translation into another language is provided for information only, for the reader’s convenience. In the event of any discrepancy in interpretation between the French version and a translation, the French version prevails and constitutes the only contractual text.
